The attached application of the above named defendant was presented, but without any proof of notice to the County Attorney.
As there has been a motion for a new trial and that motion has been denied and the case is now being appeared to the Supreme Court it will serve no good purpose to grant a further stay, the defendant will receive better care at the State prison at if affirmed he will have served that much of his sentence, if reversed he will be returned to the County jail.
The application is denied and the clerk will issue commitment and the sentence heretofore imposed will now be executed.
